13. Disclaimers
13.1 Accuracy and Errors
We create our content in good faith and make reasonable efforts to keep it accurate and, wherever possible, grounded in current evidence. We cannot guarantee that every detail in any course, program, workbook, or download will remain accurate, complete, or current over time. Research evolves, regulations change, and best practices are revised.
The Services and all content are provided for general information. We are not liable for any error, omission, inaccuracy, or outdated statement in the content, or for any action you take in reliance on it. If you spot something that looks wrong, please tell us at elizabeth@thrivingwest.com so we can review it.
13.2 Access, Uptime, and Technology
Our products are digital and are delivered through third-party hosting, course, community, scheduling, and payment platforms that we do not own or operate.
We do not guarantee that the Services will be available without interruption. Outages, maintenance windows, software defects, data loss, and platform changes can and do occur. We are not responsible for downtime or degraded performance caused by any hosting provider, platform, or software vendor, and no refund, credit, extension, or other compensation is owed for downtime. Where an outage is prolonged and within our control to address, we will make reasonable efforts to restore access or extend your access period, but we are not obligated to do so.
You are responsible for your own equipment, software, browser, and internet connection. We are not responsible for your inability to access or use the Services because of your own technology, your employer’s network restrictions, or any issue on your end.
13.3 Course and Program Descriptions
Any description, sales page, curriculum outline, module list, syllabus, or preview we publish is a general overview, not a binding specification. It describes what a product is generally expected to include at the time of publication.
We may add, remove, reorder, retitle, update, or replace modules, lessons, bonuses, live components, downloads, guest content, or other elements at any time, in our sole discretion, in order to improve the product or to keep it current. Changes to a product are not a breach of these Terms and do not entitle you to a refund, a credit, or continued access to any element that has been removed. Where practical, we will notify enrolled participants before removing a significant component.
No description constitutes a guarantee of any specific content, format, duration, level of access, or outcome.
13.4 Prerequisites and Suitability
You are responsible for deciding whether a product is right for you. We do not screen, assess, vet, or approve participants, and we do not verify anyone’s background, experience level, credentials, or readiness.
Where a product lists prerequisites, a recommended experience level, or an intended audience, it is your responsibility to confirm that you meet them before purchasing. We are not responsible if a product turns out to be too advanced, too basic, not applicable to your role or situation, duplicative of what you already know, or otherwise not a fit, and difficulty or mismatch is not grounds for a refund outside the window described in Section 6.
Completion is your responsibility. We do not guarantee that you will finish a product, and we are not responsible if you do not.
13.5 No Professional Relationship
Purchasing a product, joining the community, attending a session, or otherwise using the Services does not create any professional relationship between you and us, including but not limited to a therapist-client, counselor-client, psychologist-client, physician-patient, attorney-client, accountant-client, financial advisor-client, or employment relationship. See Section 9.1 of the terms and conditions, which describes this in detail with respect to clinical services.
We are not your personal advisor, and we do not owe you the duties that attach to any licensed professional relationship unless and until we have entered into a separate signed agreement establishing that relationship. Interacting with us in a course, group call, community thread, comment, or email does not establish one, and any response we give in those settings is general information offered to the group, not individualized professional advice to you.
13.6 Not Professional Advice
All content in the Services is provided for informational and educational purposes only. It is general in nature and is not tailored to your particular circumstances, history, health, workplace, finances, or legal position, even where it feels personal, specific, or in depth.
Nothing in the Services is medical, mental health, psychological, diagnostic, legal, financial, tax, human resources, or employment advice, and none of it is a substitute for individualized services from a qualified, licensed professional who knows your situation.
Before you act on anything you learn here, and particularly before making any decision affecting your health, your mental health, your employment, your legal position, or your finances, consult an appropriately licensed professional. Do not delay seeking professional care, disregard professional advice you have received, or discontinue any treatment or medication because of something in the Services.
13.7 Products, Tools, and Services We Mention
We sometimes reference or recommend third-party books, software, tools, assessments, apps, vendors, or services. We do not control them, and we do not guarantee that any of them will remain available, remain priced as described, remain compatible, or continue to function as they did when we referenced them.
Sourcing, purchasing, licensing, and maintaining any third-party tool is your responsibility and at your own cost. If a referenced tool is discontinued, changed, repriced, or becomes unavailable in your region, that is not a defect in our product and does not entitle you to a refund.
Any recommendation is our opinion at a point in time and is not an endorsement, warranty, or guarantee. [If applicable: We may receive a commission or other compensation for some referrals, and we disclose those relationships where they exist.]
13.8 Guest Contributors and Third-Party Views
Some content may include guest experts, interviews, panelists, contributors, licensed materials, or member contributions.
The views expressed by any guest, contributor, or member are their own. They do not necessarily reflect our views, and we do not represent, endorse, verify, or guarantee the accuracy, completeness, currency, or suitability of anything they say. We are not liable for any statement made by a guest, contributor, or member, or for any action you take in reliance on it.
The same applies to anything posted in the community by other participants. Other members are not our agents or spokespeople.
13.9 Your Use Is at Your Own Risk
You use the Services and apply the content at your own discretion and at your own risk. You are solely responsible for evaluating whether anything you learn here is appropriate for your situation, for conducting your own due diligence, and for the decisions you make and the actions you take or do not take.
We cannot and do not guarantee that any product will meet your expectations, objectives, needs, or requirements. We are not liable for any decision you make, or any consequence of that decision, based in whole or in part on the Services.
13.10 No Guarantee of Results
We do not guarantee any particular result, outcome, income, promotion, hire, performance improvement, relationship change, symptom change, or other benefit from any product or service. See Section 9.4.
Your results depend on factors outside our control, including your effort, your consistency, your circumstances, your organization, and timing. Any testimonial, case study, review, example, or result we share reflects one person’s experience and is illustrative only. It is not typical, average, or promised, and it is not a representation of what you should expect.
13.11 General Warranty Disclaimer
THE SERVICES, PRODUCTS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR NEEDS OR PRODUCE ANY PARTICULAR RESULT.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent permitted, and nothing in this section limits any right you have that cannot be limited by law.
